What is the purpose of an LMIA (when hiring a Foreign Worker in Canada)

BOOK A TELEPHONE MEETING  Dear Miss Powell, I was born in Jamaica, and I am now a citizen of Canada. I have a small business in Canada and I’m trying to hire someone from overseas, as I haven’t been able to find suitable workers in Canada. When I gave her the job offer, she asked me if I’m LMIA-exempt, or if I have an LMIA. What is the purpose of an LMIA? I can’t find workers in Canada, and everyone knows there is a labour shortage. Why is such a report necessary? Please tell me how to get that report so that I can forward it so she can apply to come to Canada and help me in my business. I look forward to your response in  The Gleaner . Thank you. OP A Labour Market Impact Assessment (LMIA) report is an opinion prepared by an officer of the federal government who has evaluated several factors to determine if the employer is indeed experiencing a labour shortage, and access the genuineness of the job offer. It is a report which signals to the department of Immigration Refugee a...

Immigration Corner | Can I work in Canada without a work permit?

Immigration Corner | Can I work in Canada without a work permit? Dear Miss Powell, Can someone work in Canada without a work permit? I hear of so many people with a visitor’s visa that go there and work. Can you tell me what types of job you can get without a work permit? – A.A. Dear A.A., You must have a work permit to work in Canada. If you work in Canada after you enter as a visitor, without authorisation to do so, you run the risk of being deported and barred from re-entering. Additionally, the employer who breach this rule could face serious penalties. There are only a few circumstances that the government of Canada has permitted individuals to work without the need to apply for separate work permit. These types of jobs are exempted from work permit. REQUEST CONSULTATION EXEMPTED WORK Some positions may not require a work permit when the employment is short term and must be on the list of exempted work. Students are exempted from seeking a separate work permit to work on or ...

Immigration Corner | Proposed change to rules for temporary foreign workers

CLICK HERE TO BOOK YOUR CONSULTATION. Dear Ms Powell, I was trying to find some information about the changes to the temporary foreign worker programme but couldn’t find answers to my concern. My father asked me to write to you as he got sick due to the way his employer is treating him and wants to change his job but is not sure if he can. Can you please tell me, what are the changes to the programme, and can my dad change his job without getting into trouble? Thanks for your help. – MM Dear MM, The Canadian government recently published the proposed Regulations Amending the Immigration and Refugee Protection Regulations (temporary foreign workers), aimed at strengthening protections for temporary foreign workers in Canada and improving the employer compliance and protections of international workers who come to Canada to work under the Temporary Foreign Worker Programme (TFWP) and the International Mobility Programme. The difference between the two programmes is that individuals that ...

Immigration Corner | Are there changes to the LMIA applications?

Immigration Corner | Are there changes to the LMIA applications?:  Dear Miss Powell, I am a small business owner, and I would like to apply for the LMIA (Labour Market Impact Assessment) to hire someone in Jamaica. The person would use this to support his application for permanent residence. Do you think my application will be approved? Are there changes to the LMIA application process? I know that there are a lot of restrictions now, so I don’t want to waste time and money if there is no chance of my application being successful. Thank you in advance for answering my question. – A.V. CLICK HERE TO BOOK YOUR CONSULTATION. Dear A.V., The Labour Market Impact Assessment, formerly called the Labour Market Opinion, is a report or document that some employers in Canada will need to get that authorises them to hire a foreign national. The report will state whether it is a negative or positive. A positive LMIA will indicate that there is a need for a foreign worker to fill the job. It wil...

Can I use my land as collateral ?

BOOK YOUR APPOINTMENT FOR A ZOOM/ TELEPHONE MEETING Dear Ms Powell, I want to apply to live in Canada, but I do not have a lot of money in my account. I know I need to show that I have money. Why does the Canadian government have this requirement? I inherited some land from my grandparents, so I know that I will have the money to go. I think the land would be very valuable as it is near to the beach and if I sell it, I could get closer to $50,000. Can I use the land as a collateral? I don’t want to sell the land until I actually get through. Would a job offer help? Thank you. ME Dear ME, Canada values immigration and its immigration policies are based on the contribution that immigrants can make to the society and economy. This was emphasised in the recent budget announcement. In fact, the government of Canada indicates on its website that...
